1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by TrueFive ("Company," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Description of Services
TrueFive provides performance-based Google review outreach services for businesses. Our services include:
Outreach to client-provided customer lists
CRM integrations
Automated review request communications
Monthly reporting of review performance
TrueFive does not guarantee a specific number of reviews.
3. Eligibility
Our services are intended for businesses and individuals at least 18 years old. By using our services, you represent that:
You are authorized to act on behalf of your business
You have authority to enter into binding agreements
You comply with all applicable laws
4. Client Responsibilities
Clients agree that:
All customer data provided to TrueFive was lawfully obtained
Customers have consented to receive communications where required by law
The client will comply with all applicable data privacy laws
The client remains responsible for its Google Business Profile
TrueFive is not responsible for violations arising from improperly obtained customer data.
5. Payment Terms
TrueFive charges $10 per review successfully generated.
Billing occurs at the end of each month
Clients are only charged for completed reviews
No setup fees
No long-term contracts
Payment method must be maintained on file
If payment fails, TrueFive reserves the right to suspend services.
6. No Guarantee of Platform Control
TrueFive does not control Google or any third-party platform. We do not guarantee:
Ranking position
Algorithm outcomes
Platform availability
Permanent display of reviews
Review generation depends on customer participation.
7. Compliance with Platform Policies
TrueFive does not generate fake reviews. We only request honest feedback from real customers. Clients agree not to request, encourage, or manipulate fake reviews. TrueFive reserves the right to terminate service if fraudulent or unethical practices are discovered.
8. Intellectual Property
All website content, branding, logos, software, and materials are owned by TrueFive. Clients may not:
Reverse engineer
Copy software systems
Replicate proprietary processes
9. Data Processing
TrueFive processes customer contact information solely to provide review outreach services. Clients remain the data controller. TrueFive acts as a data processor. Refer to our Privacy Policy for full details.
10. Termination
Either party may terminate services at any time. Upon termination:
Outstanding balances remain due
Outreach services will cease
Data may be deleted or returned upon request
TrueFive reserves the right to terminate services for nonpayment, legal violations, misuse of services, or fraudulent conduct.
11. Limitation of Liability
To the fullest extent permitted by law, TrueFive shall not be liable for indirect damages, lost profits, loss of business, platform algorithm changes, or third-party service disruptions. Total liability shall not exceed the total fees paid in the preceding 30 days.
12. Disclaimer of Warranties
Services are provided "as is" and "as available." We make no warranties regarding continuous availability, specific business results, or ranking outcomes.
13. Indemnification
Client agrees to indemnify and hold harmless TrueFive from any claims arising from improperly obtained customer data, legal violations, misrepresentation, or client misuse of services.
14. Governing Law
These Terms shall be governed by the laws of the applicable state, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes shall first attempt to be resolved informally. If unresolved, disputes shall be resolved through binding arbitration. Each party shall bear its own legal costs.
16. Modifications
TrueFive may update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
